2A.  Use of AI and Learning Technology (Ethical Disclosure)

L.R. Brain Solutions leverages proprietary Artificial Intelligence (AI) and Machine Learning (ML) technology to enhance the learning experience and service delivery.

• Transparency and Purpose: We utilize an AI algorithm to process student data, including practice submissions, written work, and academic performance metrics. This processing is performed solely for the purpose of personalized instruction, identifying specific knowledge gaps, and providing immediate feedback to the student and tutor.

• Ethical Data Use Guarantee: We guarantee that student data, including Personally Identifiable Information (PI) and academic records, is never used to train third-party commercial AI models or large language models (LLMs) outside of our direct service provision.

• Data for Product Improvement & Marketing (Mandatory): By using our service, you agree that we will use anonymized and aggregated versions of your child's learning data (data stripped of all identifying characteristics) for internal research, product improvement, enhancement of our AI algorithms, and for creating general marketing statistics and performance claims. This use of anonymized data is integral to the functioning and continuous improvement of the service.

• Security: All student data transmitted to and processed by our AI systems is protected using end-to-end encryption and robust access controls.

 

3. How We Share Your Information

We may share your information with third parties in the following circumstances:

• With Tutors: We share necessary information with tutors to facilitate tutoring sessions, such as your name, subject needs, and scheduling preferences.

• Service Providers: We engage third-party service providers to perform functions on our behalf (e.g., payment processing, hosting, analytics, customer support). These providers are obligated to maintain the confidentiality and security of the information.

• Business Transfers: Your information may be transferred to an acquiring entity in the event of a merger, acquisition, restructuring, bankruptcy, or sale of assets.

Upon verified request, we will delete your child's Personally Identifiable Information (PII) from our operational databases. Data used for mandatory AI improvement will be retained in its anonymized and aggregated form (see Section 2A).

• Opt-Out of Communications: You can opt-out of receiving promotional emails from us by following the unsubscribe instructions provided in those emails.

• Right to Opt-Out of Sale/Sharing (California Residents): If you are a California resident, you may have the right to opt-out of the "sale" or "sharing" of your personal information.

For Users in the United States (COPPA Compliance): We strictly comply with the Children's Online Privacy Protection Act ("COPPA").

• Verifiable Parental Consent (VPC): We do not knowingly collect personal information directly from children under 13 without first obtaining Verifiable Parental Consent using an FTC-approved method, as outlined on the FTC website. These methods include:

  • Verified Signature: A signed consent form returned by postal mail or electronic scan (fax/email).

  • Video Conference: A real-time video conference with trained personnel.

  • Other FTC-approved methods, such as a credit card or payment system verification.

• Data Minimization: We collect only the minimum amount of personal information necessary from a child to provide the educational service for which the parent has consented.

• No Commercial Use of Child Data (Mandatory): Personally Identifiable Information collected from children under 13 is NEVER used for targeted advertising, behavioral advertising, building commercial profiles, or any commercial purpose unrelated to the provision of the tutoring service.

• Parental Rights: Parents have the right to review their child's personal information, request its deletion, and refuse to permit its further collection or use. Please refer to Section 4 for how to exercise these rights.

If you are accessing our Services from outside the United States, your information may be transferred to, stored, and processed in the United States where our servers are located.
